Why does the CES produce model contracts of employment for staff employed in Catholic schools?
The CES produces model contracts of employment for staff employed in Catholic schools in order to ensure that the Bishops' objective that Catholic schools fulfil their responsibilities to preserve and develop the Catholic character of the school is met. It is also important that staff of the school are bound by the terms of the model contracts which reflect the specifically Catholic nature of the school and the relationship between the employer (the governing body of the school) and the employee.
How has the CES traditionally provided model contracts?
To date the CES has provided model contracts of employment for the various roles within Catholic schools in downloadable Microsoft Word format. The model contracts have always been password protected and so schools have been unable to amend the contracts to meet their particular requirements without first seeking authorisation and approval of the proposed amendments from their diocese and the CES.
How have the CES model contracts changed since they were reviewed in August 2013?
The CES recognises that it would assist schools if they were more easily able to generate contracts of employment that fit their particular needs and the needs of their individual employees and so, as part of our extensive review of the model documentation that we provide, we have refined and streamlined the model contracts available.
There are now 2 new and alternative ways of producing tailor-made contracts:
Method 1: Download and Amend
The user must choose from one of eight overarching contracts that cover the majority of roles in Catholic schools. We have taken on board feedback from schools and local authorities and the Microsoft Word version model contracts are now capable of download for amendment and adaptation in many areas without the need for diocesan and CES approval.
Method 2: Electronic Contract Generator (ECG)
By simply completing our online questionnaire, which asks the user to provide details of the employee, the school, and certain important terms of the employment relationship, then clicking ‘submit’, the answers provided are automatically populated into a PDF version of a standard CES contract of employment which is particular to the role. This allows schools to quickly and easily generate contracts of employment for their staff safe in the knowledge that, provided the questionnaire is completed correctly, all contractual clauses relevant to the role will be incorporated and the contract will be specific to the school and the employee.
What is the "CES Model School/College Contracts of Employment User Guide" and must I read it?
The CES Model School/College Contracts of Employment User Guide is a comprehensive guide to the model contracts that the CES provide. It not only sets out which of the eight model contracts should be used for particular posts, more importantly, it guides the user on which clauses need to be amended in the model contract to reflect the school and employee’s requirements. Schools must read the CES Model School/College Contracts of Employment User Guide before making any amendments to the model contracts to minimise mistakes being made.
Why has the CES produced the CES Model Contracts of Employment: Contextual Guidance?
The CES has produced additional guidance to complement the model contracts of employment for two reasons: (i) to explain why we produce the model contracts for staff employed in Catholic schools and why the Bishops’ require that Catholic schools use CES model documentation and (ii) to provide guidance and information on some of the terms used in our contracts which are either of a specifically Catholic nature, or which are technical employment law terms. Persons at the school who are involved in recruitment or the creation and issue of contracts of employment for staff must read the Contextual Guidance. It is imperative that Governors, as the employers of staff, also read the Contextual Guidance to ensure that they understand why the CES produce model contracts, why they are expected to use the CES model contracts and what the contractual provisions contained in the model contracts actually mean. The Bishops’ expect that school employers will make clear their expectations to staff in respect of the Catholic character of the school. The Bishops’ further expect schools to use the CES model contracts of employment to assist in meeting this objective.
